In the Sumy region, the criteria for companies to obtain the status of enterprises vital for meeting the needs of territorial communities during a special period have been updated. If an enterprise fails to meet the new requirements, its employees may lose their right to reservation and, consequently, deferment from mobilization.

This is due to a new directive from the Sumy Regional Military Administration dated June 9, 2026, No. 361-OD, which approved updated criteria for enterprises.

Which enterprises are affected by the new rules

The updated criteria apply to municipal enterprises, regardless of their type of activity, as well as to private companies and other businesses operating in specified sectors.

Specifically, this includes:

• agriculture, forestry, and fisheries;

• mining and manufacturing industries;

• energy;

• water supply and waste management;

• construction;

• trade;

• transport and warehousing;

• postal and courier activities.

What criteria will be used to determine the importance of an enterprise

Five main criteria have been established for an enterprise to obtain the status of being vital for meeting community needs during a special period.

The assessment will consider:

• the enterprise’s revenue;

• the number of employees;

• export activities;

• justification from local self-government bodies;

• contracts necessary to meet the needs of communities and districts during martial law.

Furthermore, proper maintenance of military records for conscripts, military personnel liable for service, and reservists is a mandatory condition. This must be confirmed by a relevant certificate on the number of employees subject to military service.

What conditions must be met

To obtain the relevant status, an enterprise must meet at least three of the criteria.

For municipal enterprises, the requirements are slightly more lenient – meeting two or more criteria is sufficient.

However, for all companies without exception, the mandatory requirement regarding the number of employees remains. For each of the last six months, the enterprise must have employed at least five insured employees who were officially paid wages.

In addition, for most enterprises, the presence of justification from the community and confirmation of tax payments to the local budget remain important.

When did the new rules come into effect

The updated criteria officially came into force on June 10, 2026.

As a reminder, Ukraine has changed its approaches to the reservation of military personnel liable for service and the identification of critically important enterprises. The reservation system will be retained, and the updates are intended to make it clearer, more transparent, and more protected against abuse.
